Entre los puntos, el proyecto de ley habilita a las empresas a pagar en hasta 12 cuotas mensuales las indemnizaciones.<\/p>\n<p>&nbsp;<\/p>\n<p>Tras el apoyo que recibi\u00f3 en las urnas, el Gobierno Nacional vuelve a poner en agenda la reforma laboral, que se ven\u00eda discutiendo en el Consejo de Mayo.<\/p>\n<p>&nbsp;<\/p>\n<p>La iniciativa, impulsada por la diputada nacional Romina Diez bajo el t\u00edtulo de \u201cLey de Promoci\u00f3n de Inversiones y Empleo\u201d y acompa\u00f1ada por un grupo de legisladores de distintos bloques, propone un ambicioso proyecto de ley: ampliaci\u00f3n de la jornada laboral, flexibilizaci\u00f3n de convenios, indemnizaciones en cuotas y m\u00e1s.<\/p>\n<p>Indemnizaciones<\/p>\n<p>&nbsp;<\/p>\n<p>Uno de los puntos m\u00e1s pol\u00e9micos del proyecto es el tema de las indemnizaciones, ya que establece un beneficio exclusivo para las Micro, Peque\u00f1as y Medianas Empresas (PyMEs): la posibilidad de pagar en cuotas las indemnizaciones u otras condenas monetarias derivadas de un juicio laboral.<\/p>\n<p>El art\u00edculo 17 de este proyecto modifica la Ley de Contrato de Trabajo (LCT) y establece que solo las PyMEs que enfrenten una &#8220;sentencia judicial condenatoria&#8221; podr\u00e1n acogerse al beneficio.<\/p>\n<p>&nbsp;<\/p>\n<p>El beneficio consiste en la posibilidad de pagar el total de la sentencia en &#8220;hasta un m\u00e1ximo de doce (12) cuotas mensuales consecutivas&#8221;.<\/p>\n<p>&nbsp;<\/p>\n<p>El proyecto aclara que esas cuotas no ser\u00e1n fijas, sino que ser\u00e1n ajustadas. El mecanismo de ajuste ser\u00e1 el establecido en el art\u00edculo 276 de la misma ley: el capital hist\u00f3rico actualizado por el \u00cdndice de Precios al Consumidor (IPC) m\u00e1s una tasa de inter\u00e9s pura del 3% anual.<\/p>\n<p>Esta medida no aplica para las grandes empresas, que deber\u00e1n abonar las sentencias en un solo pago.<\/p>\n<p>Otros puntos del proyecto<\/p>\n<p>&nbsp;<\/p>\n<p>Licencias por enfermedad<\/p>\n<p>&nbsp;<\/p>\n<p>En el cap\u00edtulo de licencias por enfermedad o accidente, se mantienen los plazos de tres o seis meses de remuneraci\u00f3n seg\u00fan la antig\u00fcedad \u2014inferior o superior a 5 a\u00f1os\u2014. En el caso de quienes tengan carga de familia y por lo tanto se encuentren impedidos de concurrir al trabajo, tendr\u00e1n derecho a percibir remuneraci\u00f3n durante seis o 12 meses. Esto \u00faltimo tambi\u00e9n variar\u00e1 de la antig\u00fcedad.<\/p>\n<p>&nbsp;<\/p>\n<p>Adem\u00e1s, se introduce un procedimiento para la verificaci\u00f3n de certificados m\u00e9dicos, que podr\u00e1 ser gestionado por la Secretar\u00eda de Trabajo del Ministerio de Capital Humano, con la posibilidad de convocar peritos, repetir estudios y aplicar sanciones a los profesionales intervinientes.<\/p>\n<p>&nbsp;<\/p>\n<p>En cuanto a la conservaci\u00f3n del empleo tras el vencimiento de los plazos de interrupci\u00f3n por enfermedad, el empleador deber\u00e1 mantener el puesto durante un a\u00f1o adicional. Si el trabajador no se reincorpora, cualquiera de las partes podr\u00e1 extinguir la relaci\u00f3n sin responsabilidad indemnizatoria.<\/p>\n<p>&nbsp;<\/p>\n<p>El proyecto tambi\u00e9n redefine el concepto de beneficios sociales, detallando una lista de prestaciones no remunerativas que incluyen desde la provisi\u00f3n de almuerzos y \u00fatiles escolares hasta el pago de servicios de telefon\u00eda m\u00f3vil y acceso a internet para el trabajador y su familia. Se aclara que estos beneficios no integran la remuneraci\u00f3n, salvo excepciones expresamente previstas<\/p>\n<p>Remuneraciones, recibos de sueldo y vacaciones<\/p>\n<p>&nbsp;<\/p>\n<p>En materia de\u00a0remuneraciones y recibos de sueldo, se habilita el pago en efectivo, cheque o acreditaci\u00f3n bancaria, y se permite la instrumentaci\u00f3n electr\u00f3nica de los recibos, que deber\u00e1n contener informaci\u00f3n detallada sobre el empleador, el trabajador, los conceptos liquidados y las deducciones practicadas.<\/p>\n<p>&nbsp;<\/p>\n<p>Respecto a las\u00a0vacaciones, se flexibiliza la \u00e9poca de otorgamiento y se permite la fragmentaci\u00f3n en per\u00edodos no menores a una semana, garantizando que cada trabajador pueda gozar de sus vacaciones en temporada de verano al menos una vez cada dos a\u00f1os, salvo que opte en contrario. Adem\u00e1s, se establece que los trabajadores unidos en matrimonio o uni\u00f3n familiar que trabajen para el mismo empleador podr\u00e1n solicitar el goce conjunto de las vacaciones.<\/p>\n<p>&nbsp;<\/p>\n<p>El texto incorpora la posibilidad de que las convenciones colectivas de trabajo establezcan reg\u00edmenes adaptados a los cambios en las modalidades de producci\u00f3n, incluyendo la gesti\u00f3n de horas extras, bancos de horas y francos compensatorios, siempre respetando un m\u00ednimo de 12 horas de descanso entre jornadas.
