A la par, se expande la modalidad espec\u00edfica para taxistas. En Paran\u00e1, no est\u00e1 autorizado.<\/p>\n<p>En los siete a\u00f1os que la Uber lleva operando en el pa\u00eds, ha habido fallos, sentencias y resoluciones con diversos resultados. El \u00faltimo movimiento jur\u00eddico fue bastante resonante. En un exhaustivo fallo de 285 p\u00e1ginas, el Juzgado de Primera Instancia en lo Contencioso Administrativo y Tributario n\u00b0 15 de\u00a0<b>la justicia porte\u00f1a, a cargo del juez V\u00edctor Trionfetti, declar\u00f3 que el servicio de Uber es ilegal<\/b>.<\/p>\n<p><b>Se trata de un fallo de primera instancia, que no est\u00e1 firme y que ser\u00e1 apelado. Por eso, no tiene efectos pr\u00e1cticos<\/b>\u00a0en lo inmediato, pero, indudablemente, se trata un an\u00e1lisis jur\u00eddico del &#8220;Caso Uber&#8221; que dar\u00e1 que hablar y que sentar\u00e1 nuevos antecedentes y bases para su discusi\u00f3n.<\/p>\n<figure class=\"embed\"><img decoding=\"async\" title=\"\" src=\"https:\/\/elonce-media.elonce.com\/fotos-emb\/2021\/03\/26\/o_1616797608.gif\" alt=\"\" width=\"640\" \/><\/figure>\n<h5>Detalles del fallo<\/h5>\n<p><b>Uno de los puntos clave del fallo es que sostiene que el servicio de Uber no puede reducirse a un acuerdo entre privados<\/b>. Por el contrario, es un servicio de transporte de pasajeros. Se trata de una diferencia que puede parecer t\u00e9cnica pero que tiene consecuencias concretas:\u00a0<b>si no se trata de un servicio de transporte de pasajeros, las exigencias para las licencias de los conductores y los seguros son considerablemente m\u00e1s relajadas<\/b>.<\/p>\n<p>El juez Trionfetti argumenta que, para manejar un Uber, por ejemplo,\u00a0<b>no es necesario presentar un certificado de antecedentes penales<\/b>. Adem\u00e1s, los choferes &#8220;pueden sortear los controles de alcoholemia con pisos de tolerancia m\u00e1s alto que los que corresponde exigir a los conductores profesionales&#8221;, sostiene el fallo en un pasaje.<\/p>\n<figure class=\"embed\"><img decoding=\"async\" title=\"\" src=\"https:\/\/elonce-media.elonce.com\/fotos-nuevo\/2021\/03\/29\/o_1617018702.jpg\" alt=\"\" width=\"640\" \/><\/figure>\n<h5>Legislar la actividad<\/h5>\n<p>Tambi\u00e9n dictamina que &#8220;<b>la fragilidad de la cobertura de los usuarios de Uber en materia de seguros por siniestros viales es n\u00edtida<\/b>&#8220;. Estas cuestiones, sumadas a otras, terminan delineando, para la Justicia, un escenario de inseguridad para los pasajeros e, incluso,\u00a0<b>para peatones o conductores que puedan estar involucrados en un accidente vial con un Uber<\/b>.<\/p>\n<p>En uno de los fragmentos m\u00e1s duros del fallo, el juez afirma que &#8220;la elusi\u00f3n de Uber y los socios-conductores de m\u00faltiples normas administrativas y posiblemente de normas tributarias locales, es decir, la realizaci\u00f3n pr\u00e1cticamente furtiva de la actividad,\u00a0<b>sin cumplir normas administrativas inherentes al transporte, al tr\u00e1nsito y a los deberes hacia los usuarios y consumidores, torna ilegal a la actividad<\/b>&#8220;.<\/p>\n<p><b>Cabe destacar que el fallo del juez Trionfetti no es meramente prohibitivo. Por el contrario, exhorta al Estado a regularizar la actividad<\/b>. Ese fue un punto celebrado por Alejandro Poli, titular de la Federaci\u00f3n Argentina de Remiseros. &#8220;Es una importante resoluci\u00f3n, sobre todo por la notificaci\u00f3n a los legisladores de la Ciudad de Buenos Aires y\u00a0<b>al Congreso nacional, para que tomen cartas en el asunto y legislen<\/b>\u00a0en base a estas aplicaciones&#8221;, expres\u00f3.<\/p>\n<h5>La estrategia de Uber<\/h5>\n<p>Adem\u00e1s de dar pelea en el frente legal,\u00a0<b>la estrategia de Uber parece ser socavar las bases de sus principales adversarios: los taxis y remises<\/b>. Despu\u00e9s de a\u00f1os de enfrentamientos, Uber est\u00e1 yendo por el camino de la seducci\u00f3n y la integraci\u00f3n. Fue hace dos a\u00f1os<\/b>, con discreci\u00f3n, primero en CABA y luego en Mendoza y Mar del Plata. En febrero de este a\u00f1o se sumaron se sumaron C\u00f3rdoba, Tucum\u00e1n, Corrientes, Salta, Santa Fe, Rosario, Comodoro Rivadavia, Jujuy, Neuqu\u00e9n, Paran\u00e1, Posadas, Resistencia, Bah\u00eda Blanca y Reconquista.
